TERMS OF SERVICE
Our promises, in plain language.
Version 2026-07-21, effective July 21, 2026. If anything here is unclear, ask us; we'd rather explain than hide behind fine print.
What Everline is
Everline is a phone companion for families. When your loved one calls and you can't answer, Everline answers for you, in a voice you recorded yourself, guided by memories and notes you provide. Conversations are generated by artificial intelligence. They are warm and personal, but they are AI-powered, not a live person.
These terms are an agreement between you and Everline. By creating an account or using the service, you're agreeing to them. We've written them to be read, not skimmed past, so they're short and in plain language.
What Everline is not
Everline is not a medical device, a healthcare service, or a substitute for professional care of any kind. It does not diagnose, treat, or monitor any condition.
Everline is not an emergency service. It cannot call 911 or summon help. When a call sounds like a real emergency, Everline makes a best effort to text the family contacts you chose (you can turn these alerts off in settings), and a text can be delayed or missed, so it is not something to rely on for safety. If your loved one may need urgent assistance, please make sure they have a way to reach a person or emergency services directly.
Everline is a companion for the moments in between, not a replacement for your calls, your visits, or the care of the people around them.
Not an emergency service, in any way
This matters enough to have its own section. Everline is not an emergency service, is not a 911 relay, and is not a medical alert or personal emergency response system. It cannot call 911, cannot dispatch police, fire, or medical help, and cannot summon any person to your loved one's side, under any circumstances.
When a call sounds distressing, Everline makes a best effort to text the family contacts you chose. Those alerts are a courtesy, not a safety system: they can be delayed, they can fail to send, and they can be missed entirely. The same is true of transcripts and summaries. Do not rely on Everline, its alerts, or its records for safety monitoring, welfare checks, fall detection, or noticing a medical event.
If you or your loved one may be in danger or needs urgent help, call 911 (or your local emergency number) right away. Please make sure your loved one always has a direct way to reach a real person and emergency services that does not depend on Everline.
Your account
You need to be at least 18 to create an account, and the information you give us should be accurate. You're responsible for keeping your password private and for what happens under your account.
Everline is open to new families; anyone can create an account for their own loved one. An account is meant for one family, and when you invite relatives to join yours, you're sharing your family's space with them, so please invite the people you trust with it.
Voices and consent
A voice may only be recorded and used on Everline with the explicit consent of the person it belongs to. When you record your voice, you're giving that consent for one purpose: speaking with your own family on your own Everline line. When you invite a family member to record theirs, you're confirming they've agreed to the same.
Never record or upload someone's voice without their permission. If we learn a voice was added without consent, we'll remove it.
The audio you record is used only to prepare your Everline voice, and the recordings themselves are deleted once that's done. You can remove a voice at any time from your account, and it will be deleted completely.
Honesty within the family
Everline speaks in your voice so that a call feels like family, and what your loved one hears should be a kindness, not a trick played on a stranger. The service is for your own family members, with the knowledge and blessing of the people who care for them. You know your family best; use Everline in the way that is kindest to yours.
Paying for Everline
Plans are a simple monthly price, described on our pricing page, and each plan includes a pool of conversation minutes every month. If a month runs past its included minutes, conversation simply continues at $0.30 per minute. You set your own monthly ceiling for those extra minutes, and it only rises if you choose to raise it.
Our promise is simple: no bill sneaks up on you. We let you know gently as a month's included minutes run down, and when a month reaches the monthly ceiling you set, new calls pause and check in with you before anything continues, so adding more minutes or moving up a plan is always your choice. If we ever change a price, we'll tell you ahead of time and you can cancel before it takes effect.
You can cancel whenever you like, and your service continues to the end of the period you've paid for.
Your content stays yours
The memories, notes, recordings, and conversations in your account belong to you and your family. You give us permission to use them only to run the service for you: answering your loved one's calls, preparing your voice, showing you transcripts.
We do not train AI models on your voice, your conversations, or your family's information. We do not sell any of it, to anyone, ever.
Leaving, and being forgotten
You can cancel your account at any time. When you do, or whenever you ask, we delete your family's data: voices, recordings, transcripts, memories, all of it. Deletion requests are honored completely and promptly.
The honest fine print
We work hard to keep Everline answering, but no phone service can promise perfection. Calls can drop, carriers can hiccup, and an AI companion can occasionally say something imperfect. The service is provided as-is, and to the extent the law allows, our liability to you is limited to the amount you've paid us in the twelve months before a claim.
Nothing in these terms limits rights that the law doesn't allow us to limit.
No warranties, and the limits of our liability
Here is the fuller, more formal version of that promise's edges. The service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any call, alert, transcript, or notification will be delivered, accurate, or complete.
To the maximum extent permitted by law, Everline and its founder will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, or for any harm, injury, or outcome arising from your use of, reliance on, or inability to use the service, however caused and under any theory of liability, even if we were told such damages were possible.
To the same maximum extent, our total combined liability for all claims relating to the service is capped at the amount you paid Everline in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain of these exclusions or limits; where the law says a limit cannot apply to you, it does not.
Dispute resolution: talking first, then arbitration
If something goes wrong, please write to us first through our contact page at https://everline-care.vercel.app/contact, describing the problem and how you'd like it resolved, and we will do the same if we have a concern with you. Both sides agree to try in good faith to resolve any dispute informally for at least 30 days from that first note before starting any formal proceeding. Most things really can be worked out with a conversation.
If we can't work it out, you and Everline agree that any dispute arising out of or relating to these terms or the service will be resolved by binding arbitration on an individual basis, rather than by a lawsuit in court, except that either side may instead bring a qualifying claim in small claims court. The arbitration will be conducted in California (or remotely, by phone or video, if you prefer) before a single arbitrator under the rules of a recognized arbitration provider, and the arbitrator's decision will be final and binding.
Both sides also agree that disputes may be brought only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
Nothing in this section waives rights that the law does not allow to be waived, and either side may always seek relief in small claims court for disputes within that court's scope.
Where and how these terms apply
Everline is operated from California, and these terms are governed by the laws of the State of California and the United States. If a disagreement ever arises, we'd genuinely like to hear from you first; most things can be worked out with a conversation.
If we make meaningful changes to these terms, we'll let you know by email or in the app before they take effect.
Changes to these terms
As Everline grows, these terms will occasionally need to grow with it. When we make a meaningful change, we'll tell you by email or in the app before it takes effect, and continuing to use the service after that date means you accept the updated terms. If you don't agree with a change, you can cancel, and your service continues under the terms you accepted through the end of the period you've paid for.
Each revision carries a version date so you always know which text you agreed to. This is version 2026-07-21, effective July 21, 2026.
